Bauchi: Court Strikes out Case Challenging Eligibility of APC Guber Candidate

The Presiding judge of the Federal High Court, Bauchi, Justice Mohammed Garba Umar, has struck out a suit challenging the eligibility of the All Progressive Congress (APC) Governorship candidate, Alhaji Mohammed Abubakar, over alleged irregularities in the recent governorship primary election of the party.
Aspirant in the last APC governorship primary election in the State, Comrade Mohammed Abdullahi Tanko Ningi, filed a suit against APC challenging the competence of the last primary election of the the party following irregularities and over voting, while appealing to the court to stop Abubakar from parading himself as Bauchi APC Governorship candidate as well as stopping the party from submitting his name to the electoral body as the their candidate.
Other defendants in the suit are Independent National Electoral Commission (INEC) and the APC governorship candidate, Mr. Mohammed Abdullahi Abubakar.
Addressing newsmen in Bauchi last weekend, counsel to Abubakar, Mr. Abdulkarim Kabiru Maude, told news men that, “After they filed the suit, we filed a preliminary objection of the entire suit. We challenged the jurisdiction of the court to entertain the suit because from what was submitted in the court, the complainant only purchased the APC governorship form but he didn’t contest the election, he didn’t explore all internal mechanism within the party before he went to court and we asked the court to dismiss the case and the judge agreed with our submission and he struck out the suit. He now ordered the complainant to pay each of the defendant twenty thousand Naira.”
When contacted, the aspirant, Tanko Ningi, directed his Director, Media and Strategy, Abdullahi Isiaka, to speak to newsmen.
He said even though the court struck out the suit, they would study the ruling, meet with their counsel, supporters and stake holders before taking the necessary action.
